TRAFFIC OFFENSES:

DRIVERS UNDER THE AGE OF 21

Drivers under the age of 21 will have their drivers license suspended if:

  • Convicted of a traffic offense that is a 4 point violation or more:
    • Reckless Driving (4 pts)
    • Improper passing on hill or curve (4 pts)
    • Exceeding the speed limit by 24 but less than 34 miles per hour (4 pts.)
    • Aggressive Driving (6 pts)
    • Unlawful passing of a school bus (6 pts.)
    • Exceeding the speed limit by 34 miles per hour or more (6pts)
  • Period of Suspension
    • 1st conviction: Six Months
    • 2nd conviction: Twelve months

DUI

The law of Georgia provides that a person to be considered DUI requires that no person shall drive or be in actual physical control of any moving vehicle while:

  1. under the influence of alcohol to the extent that that it is less safe for the person to drive;
  2. Under the influence if any drug to the extent that it is less safe for the person to drive;
  3. Under the intentional influence of any glue, aresole, or other toxic vapor to the extent that it is less safe for the person to drive;
  4. Under the combined influence of any two or more of the substances specified in paragraphs (a) through (c) of this subsection to the extent that it is less safe for the person to drive;
  5. The persons alcohol concentration is 0.08 grams or more at any time within three hours of after such driving or being in actual physical control from alcohol consumed before such driving or being in actual physical control ended; or
  6. Subject to the provisions of subsection (b) of this code section, if there is any amount of marijuana or a controlled substance, as defined in the Official Georgia Code 16-13-21, present in the person=s blood or urine, or both, including the metabolic and derivative of each or both without regard to whether or not any amount of alcohol is present in the person=s breath or blood.

Minimum and Maximum Sentence requirements for DUI First Offense:

  • Jail Time:
    If you tested .08 or higher you will be required to serve a minimum of 24 hours. (The statute states that you must serve a minimum of 10 days in custody, however, the judge can suspend or probate all but 24 hours.) Maximum time to which you can be sentenced is 12 months.
  • Fines:
    $300.00 to $1000.00, plus court costs and statutory fees

MISDEMEANORS

Most misdemeanor offenses can carry a sentence of up to 12 months in jail and/or up to a $1000.00 fine.

Common Misdemeanors offense include:

  • DUI
  • Possession of Marijuana (less than an ounce)
  • Battery
  • Simple Battery
  • Speeding
  • Racing
  • Most traffic offenses
